To strengthen the protection for design, the JPO extended the protection term for design registration for applications filed on or after April 1^st,2020, that is: the term of protection of Design Registration is now 25 years from the application filing date. Before this revision, the protection term of 20 years from the registration date for application filed before April 1^st,2020. This practically means that the protection term is extended by a little less than 5 years.

 

This new term is also appliable for applications filed on or after the above date in Japan for design applications claiming priority through Paris Convention.

 

Further, it should be paid attention to that the protection term for a related design is 25 years from the filing date of the original design, as well. We will provide additional information on this matter separately.

 

For your reference, please be informed that the term of protection of Design Registration in South Korea is 20 years from the filing date, while in China it is 10 years from the filing date.
